Emmanuel J. Argentieri is a member of the firm and focuses his practice on all aspects of the mortgage default services industry. He has defended claims against lenders under TILA, HOEPA, ECOA, and the NJCFA, as well as general lender liability claims under New Jersey and Pennsylvania state law. He has represented numerous Fortune 500 companies in foreclosures and as creditors in both state court and federal bankruptcy proceedings, as well as residential lenders, commercial lenders and municipalities in state court foreclosure matters.

He has also represented title insurance companies in all areas of claims litigation. Mr. Argentieri has successfully prosecuted appeals for his clients before both the state and federal courts. He successfully represented a creditor in the published case of In re Lancaster Bankers 388 B.R. 106 (Bankr. D.N.J. 2008). At issue in the case was whether a Chapter 7 Trustee could claim a superior interest in a mortgage that had been assigned to another party where the assignment of mortgage had not been recorded prior to the bankruptcy filing. Mr. Argentieri argued that the holder of the executed but unrecorded assignment of mortgage had perfected title in the mortgage account superior to the Ch 7 Trustee and the court agreed with his position. Mr. Argentieri has also successfully argued on behalf of a client in the published opinion of Haven Savings Bank v Zanolini 416 N.J. Super. 151 (App Div. 2010) which dealt with the appropriate fee an asset locating company could charge for its services under the New Jersey Uniform Unclaimed Property Act.

He has lectured on bankruptcy and creditors’ rights and mortgage foreclosure for the New Jersey Institute for Continuing Legal Education (NJICLE), the Camden County Bar Association and the Garden State Alliance Paralegal Convention NJ Foreclosure/Bankruptcy Practice. He co-authored NJICLE’s Bankruptcy Practical Skills Series, 2005 Edition, a continuing education textbook for newly admitted attorneys.
